Living Trusts

Living trusts: general information.

What a living trust is, how it differs from a will, and the questions to bring to an attorney.

What is a living trust?

A living trust, also called a revocable trust, is an arrangement a person sets up during their lifetime to hold some or all of their property. The person who creates it is often called the grantor or trustor.

The grantor usually acts as trustee and keeps control of the property while living, and can generally change or cancel the trust. The trust names a successor trustee, who manages or distributes the property after the grantor dies, or if the grantor can no longer manage their affairs.

A trust and a will

A will says who receives your property after you die. A living trust holds property during your lifetime and continues after it. Many people who have a trust also have a will. Which documents make sense depends on your family, your property and your wishes.

People often ask whether a trust means their family can skip probate court. The answer depends on what you own, how the trust is written, and whether your property is actually placed in the trust. A licensed attorney can explain how the law applies to you.

Questions to bring to an attorney

  • Is a trust, a will, or both a good fit for my situation?
  • Who should I name as successor trustee, and as a backup?
  • How is property such as a home or bank account placed in the trust?
  • What happens to property that is never placed in the trust?
  • How and when should the trust be reviewed or updated?
  • What will the work cost, and what is included?
